「海峽兩岸共同打擊犯罪及司法互助協議」 (簡稱兩岸司法互助協議)於2009年6月25日生效，迄今天屆滿五週年。法務部公布資料指出，至今年5月底，經法務部和警、調查局與大陸公安、檢察署、法院、司法部互提出請求協助的總數達5萬3260件。

法務部說，兩岸相互完成協助案件4萬4618件，完成率83.77%；平均每月完成700餘件，每月自大陸遣返刑事犯6人；每日雙方往返送達司法文書20件。互助數量龐大，遠超過我國與其他任何國家的合作情形，目前仍以顯著快速的幅度繼續成長。

例如，兩岸緝捕罪犯遣返、送達文書、調查取證等案件，2011年間7482件；2012年增至9087件；2013年間已達1萬2623件，近3年案件量成長近6成。
