男童竄出馬路駕駛撞上無罪

王姓男子開車撞傷穿越馬路的王姓男童，被依過失傷害罪嫌起訴；法官調查發現，王童是突然違規過馬路，王並未違規，事出突然才撞上，基於信賴原則，判王無罪。

法界人士指出，「信賴原則」是指駕駛人駕車時遵守交通規則，因他人未遵守交通規則而發生車禍，可免除刑責。

法院調查，王姓男子前年五月十二日深夜，開休旅車沿新北市新莊區福營路往建國一路方向行駛，撞上穿越馬路的九歲王姓男童；王童右小腿擦傷、腓骨骨折。檢方依過失傷害罪起訴。

王姓男子供稱，王童突然出現，他煞車不及才撞上，當時他車速只有十公里，並未違規。法官調閱監視器畫面，發現車禍路段狹窄，王與對向一輛轎車會車時讓對方先行後再往前開，但男童自對向車輛後方突然出現並穿越馬路，王的休旅車就撞上男童。

法官查出，男童與母親同行，他先跑到對向車道，卅秒後母親見左右來車，叫他回到她身旁，男童未走行人穿越道，直接穿越馬路與母親會合，被王撞上。
